Article 1: Scope of the agreement
1.1. Unless otherwise agreed in writing, the legal relationship between the parties is established by these general terms of purchase, which the customer/buyer hereby declares to have read and understood, and which prevail over the terms of purchase of the customer/buyer.
1.2. Selected Shorts is affiliated with Fonk vzw, Naamsestraat 96, 3000 Leuven.
Article 2: Special offers, confirmations, prices and pick-up
2.1. Unless otherwise agreed in writing, the prices of Selected Shorts are non-binding and are of informative nature only. Prices are subject to inadvertent pricing errors, price increase and item availability.
2.2. The prices offered are valid on the day of purchase. Should a price increase occur between the day of purchase and the date of delivery due to a change in exchange rates, value added tax or other additional taxes on the merchandise, this change will be added to the product price, and does not entitle the buyer to dissolution.
2.3. All prices on the website are nett prices inclusive of VAT and tax, unless explicitly mentioned otherwise.
2.4. The price of packaging is included in the price, unless otherwise agreed.
2.5. Orders are always sent to the buyer. At this time, there is no possibility for the customer to pick up the order in person.
Article 3: Delivery
3.1. The delivery dates provided are estimates only. Selected Shorts aims to deliver the products as close as possible to requested delivery date. Failure to meet any delivery date does not entitle the Buyer to dissolution, cancellation of the order, a price reduction or a liability claim of any kind.
3.2. In case of operating trouble, strikes, causes beyond the control of the Seller and/or government action, Seller reserves the right to cancel delivery and/or execution of order. Operating troubles also include the failure of Seller's suppliers to make timely delivery of material or components, for whichever reason. Seller is free to consider the agreement as disbanded by law without compensation or to choose for an extension of dates for delivery and/or execution for a period equal to the time lost by reason of any such delay. The cancellation of the agreement or extension of the delay will be communicated by Seller by means of a notice by fax or by letter.
Article 4: Payment
At this time, there are two ways to make a payment to Selected Shorts.
* Payment by credit card
Selected Shorts accepts payment by Visa, MasterCard and American Express. All payments are handled securely by Paypal (eBay Group). PayPal is the world's market leader in online payment. Your financial data will be treated in the most secure way possible and even Selected Shorts will not have access to your credit card number, this information is restricted to Paypal.
Payment by (international) bank transfer
The customer can pay with an (international) bank transfer on account number 001-2875978-04 (Fortis Bank). International transfers also require the following data: IBAN: BE10 0012 8759 7804 // BIC/SWIFT-Code: GEBABEBB. All additional service fees of these transfers are to be paid fully by the sender and will in no way be charged to Selected Shorts.
Article 5: Cancellation order, return, exchange
5.1. When you have not yet received your order and wish to cancel it, we urge you to email info(ad)selectedshorts.com immediately. You will be notified as soon as possible when your order has been cancelled.
5.2. Products may be returned to below address up to 7 days after receiving your order. The returned DVDs will only be accepted in original condition and package. If the cellophane wrapping has been opened or removed, the DVDs will not be taken back. The return address is: Selected Shorts, Naamsestraat 96, 3000 Leuven.
5.3. Received DVDs cannot be exchanged.
Article 6: Complaints, liability
6.1. Please make sure that you receive an undamaged package upon receipt and check whether the delivery is in accordance with your order. Complaints over visible flaws or defects in delivering the order must be made within three days after receipt.
Article 7: Applicable law and competent jurisdiction
7.1. Only Belgian law is applicable to our contracts.
7.2. On the occasion of a dispute, courts of the Leuven judiciary territory only have jurisdiction. |
